“Family” of marks and use of a trademark in an amended form: continuation (and conclusion?) of a judicial saga

In a decision dated June 3, 2014, the Court of Cassation in France ruled on the assessment of the genuine use of a trademark in an amended form, in the particular context of a “family” of marks.

In essence, the Court held that the genuine use of a trademark could be established by the use of the sign in an amended form, no matter if this modified form is also registered as a trademark.

This article comments upon a recent decision (TGI of Paris, october 17, 2014, SC Château Beychevelle v. CGM Vins, RG 12/08104), in which French judges were asked to assess the likelihood of confusion between two complex trademarks.
